BayTSP, a Californian company specialising in on-line information monitoring and compliance services for a variety of industries has announced a new tool to monitor piracy on-line.

The software, called FirstSource, allows ISP's to track users offering pirated content on their networks. The system actively monitors traffic and identifies the user that performed the initial upload. Matching file names against a pre-assessed list, the software verifies the content is in fact copyrighted work, and then notifies ISP administrators. They system builds an infringement database, logging information on exactly what users have shared / uploaded; user specific information like IP addresses are also stored as evidence.

FirstSource monitors two of the most popular p2p networks, eDonkey and Bit Torrent. Worryingly, the system can also be instructed to issue DMCA take-down notices to users automatically. Previous attempts at automating this process have proved un-successful and in-accurate.

"Pirated copies of movies and software typically appear on-line within hours of release," said Mark Ishikawa, CEO of BayTSP. "Identifying and taking action against the first uploaders can greatly slow the distribution of illegally-obtained intellectual property and might make users think twice before doing it." The software highlights a continued battle between on-line users downloading pirated content and media associations; developments of software like FirstSource and the recent success in taking off-line popular file sharing hubs has tipped the scales towards the media associations. However, one site does seem determined to fight back. As we reported previously, bit-torrent hub LokiTorrent had launched a legal defence fund to fight back against an MPAA lawsuit; so far, the site has received $40,000+ in donations.

but information that Bay is able to make ISP's cut Connections to the First sources immediately was not . So I underestimated the role of "First Source" at the first look.

Identifying the first individuals who upload illegal content allows companies to track all subsequent users who download and share a particular file. Initial tests of the FirstSource service indicate that several thousand copies of a movie available for download on the eDonkey and Bit Torrent networks can be traced back to the initial uploaded file.

EDonkey and Bit Torrent are two of the most popular file sharing networks and use a technique called swarming that allows users to download slices of a file - like a pirated movie or software application - from multiple other users simultaneously. As users download a file, they also share the portions they've already received.
FirstSource monitors for the first uploads of a client's intellectual property to the eDonkey and Bit Torrent networks. When the system spots a file name matching the client's content, it initiates a download to confirm that the file is what it appears to be. Once the content is validated, the system captures the IP (Internet Protocol) address and identifying information of other users downloading and sharing the pirated material.
The system also logs which portions of the file that each user shares. This data is stored in an infringement database as evidence in the event the client decides to pursue litigation against the file sharers.

Clients can monitor the system via a Web-based interface and have the option of automatically or manually issuing Digital Millennium Copyright Act-compliant take down notices, even while the downloads are still in progress.

Thats great. Is there a way to stop BayTSP's monitoring system?
With the internet booming as it is, artists should remove big corporations from the equation and privatly release their work. Once you put your work on a torrent search/IRC forum, etc... im sure you will get greater publicity that what a corporation could provide.
